From PAN-mandatory rent receipt to 60-day max security deposit – 7 rule changes that protect tenants & sellers this year.
1. PAN Must on Receipt >₹50 k
Seller must quote tenant PAN on rent receipt if monthly rent >₹50 k. Fail = ₹10 k penalty. Ask for it – helps you claim HRA hassle-free.
2. Security Deposit Cap
Maharashtra & Karnataka now limit deposit to max 2 months’ rent (was 3-6). Other states drafting similar bill – negotiate down.
3. 30-Day Notice Standard
Model Tenancy Act adopted by 8 states: either party can exit with 30-day written notice; longer clause invalid unless mutually signed.
4. Tenant Can’t Be Evicted Without Cause
Owner must show breach (sub-letting, damage, non-payment) to tribunal; can’t remove on whim. Gives stability to remote workers.
5. Rent Hike Cap
Cities like Chennai, Pune cap yearly hike at 8 % unless major infra upgrade proven. Ask society bye-laws copy.
6. Fire Safety Mandatory
PGs >16 beds must install fire extinguishers & emergency exit sign. Valid NOC must be displayed – check before you shift.
7. Digital Agreement Valid
e-Stamp + e-Sign = legal. No need to visit sub-registrar for 11-month lease. Do it on phone in 10 minutes.
